Die actio de dolo, die Klage wegen Arglist, ist im System des Römischen Privatrechts eine subsidiäre Klage. Sie wird auf den Juristen C. Aquilius Gallus zurückgeführt und bei Ulpian folgendermaßen beschrieben: quae dolo malo facta esse dicentur, si de his rebus alia actio non erit et iusta causa esse videbitur, intra annum, cum primum experiundi potestas fuerit, iudicium dabo. Bezeichnend ist die Subsidiarität der Klage: Sie soll nur gegeben werden, wenn aus einem anderen Grunde nicht geklagt werden kann. Darüber hinaus fällt die Jahresfrist auf, innerhalb derer die actio geltend gemacht werden muss. Diese Regelung findet sich noch heute in § 124 BGB oder Art. 60 ZGB.
